Oklahoma DUI
Attorneys Charles Sifers &
Jeff Sifers believe your representation at the Oklahoma
Department of Public Safety or Oklahoma DMV, regarding your Oklahoma Drivers
License, is equally as important, as your representation in an
Oklahoma Municipal Court such as Oklahoma City Oklahoma
Municipal Court, or Edmond Oklahoma Municipal, Warr Acres
Municipal or, Bethany Oklahoma. And, in any Oklahoma
District Court such as Oklahoma County District Court, Cleveland
County District Court, Canadian County District Court,
Pottawatomie County District Court or, Logan County District
Court.
The loss of
your Oklahoma drivers license due to an Oklahoma DUI or Oklahoma
APC charge is just another form of punishment, although the
Supreme Court of Oklahoma has calls it "remedial" and not
punishment. Few people arrested for Oklahoma DUI or
Oklahoma APC in Oklahoma are in agreement. Instead, they
find the revocation or loss of their Oklahoma driver's license,
and the requirements to get the Oklahoma license back or
reinstated, the most severe punishment.
When you are arrested for a DUI or
APC, you will be asked to submit to a chemical test. In most
instances, it will be a breath test. Occasionally, the officers
will request that you take a blood test. If you fail (a .08 if
you are 21 years old or older; .02 if you are UNDER 21 years
old) OR refuse the chemical test, the officer will seize your
driver’s license. The Department of Public Safety ("DPS") will
receive from this officer what is called an "Officer’s
Affidavit" that reflects this failure or refusal of the test. A
copy of this affidavit will be given to you to use as your
driver’s license for thirty (30) days after the arrest.
License Revocation periods and
requirements to reinstate.
